Principles

This website processes personal data only to the extent necessary for its operation and for responding to inquiries. It does not set cookies, does not use analytics or tracking services, and does not load content from third parties; the fonts are served from the website’s own server.

Hosting and Server Log Files

The website is hosted by Netlify, Inc., San Francisco, USA. When a page is accessed, the server processes technically necessary data: IP address, date and time, the page accessed, the amount of data transferred, the previously visited page (referrer), and information about the browser and operating system. The purpose is to deliver the website and keep it secure; the legal basis is the legitimate interest in secure and reliable operation (Art. 6(1)(f) GDPR).

Netlify processes this data as a processor. The data processing agreement pursuant to Art. 28 GDPR is part of Netlify’s terms. According to Netlify, it is certified under the EU-U.S. Data Privacy Framework; transfers to the USA are therefore based on the European Commission’s adequacy decision (Art. 45 GDPR) and, as a fallback, on standard contractual clauses (Art. 46 GDPR).

According to the data processing agreement, Netlify retains logs of the systems used to operate the service for 90 days online and for one year offline.

Contact Form and Email

If you use the contact form or write to contact@georgpichl.art, your information (name, email address, the content of your message and, for the form, the work you are inquiring about, if applicable, as well as the technical data that Netlify stores with each submission: IP address, browser identifier, and previously visited page) is processed in order to respond to your inquiry. The legal basis is taking steps at your request prior to entering into a contract (Art. 6(1)(b) GDPR) or the legitimate interest in responding to your inquiry (Art. 6(1)(f) GDPR).

The contact form is processed by Netlify’s form service (Netlify Forms). Submissions are stored in the website’s Netlify account and sent by email to a mailbox at GMX (1&1 Mail & Media GmbH, Germany). To prevent spam, the form contains a check field that is invisible to humans; in addition, Netlify checks submissions using the Akismet service (Automattic Inc., USA), which Netlify uses as a subprocessor; this is covered by the agreement with Netlify.

Messages to contact@georgpichl.art are forwarded to the same GMX mailbox by the email forwarding service of the domain provider Spaceship, Inc. (USA). According to Spaceship, transfers to the USA are based on standard contractual clauses (Art. 46 GDPR).

Submissions and messages are deleted as soon as they are no longer needed for processing, unless statutory retention obligations apply, for example in the case of a purchase.

Your Rights

You have the right of access, the right to rectification, erasure, and restriction of processing, the right to data portability, and the right to object to processing based on legitimate interests (Arts. 15 to 21 GDPR). To exercise these rights, please write to contact@georgpichl.art.

If you believe that the processing of your data violates data protection law, you can lodge a complaint with the Austrian Data Protection Authority (www.dsb.gv.at).
